Wenn sie dann über andere Kanäle in die USA gelangt und dort nur von Endnutzern genutzt wird, können ja Apple und der App-Anbieter nichts dafür. Apple hat damals nach einer ersten Anfrage den Kontakt abgebrochen. Und dann angefangen Mitarbeiter von masimo abzuwerben.<br /> Es ist nicht so, das masimo etwas nicht wollte und jetzt den Klageweg vorzieht.</div>

Hinzu kommt, dass Freedom-To-Operate-Recherchen auch nicht immer alles an relevantem Stand der Technik finden und plötzlich sieht man sich mit Berechtigungsanfragen oder Cease-and-Desist-Briefen konfrontiert. Da heißt es dann abzuwägen, ob man auf Risiko geht oder das kurz vor dem Launch stehende Produkt komplett neu designt.
